Important Update Regarding Trust Operations and Payment Percentages
The Zonolite Attic Insulation (ZAI) Trust will operate for a minimum of 20 years from its inception, meaning it will remain active until at least 2034, and is likely to continue operating until 2039 depending on the total volume of claims received. Because the Trust has a finite amount of funds, the payment percentage, which sets the maximum amount of money a claimant can receive, is expected to decrease over time. This managed reduction is necessary to guarantee equitable and fair treatment for future claimants who have yet to file. Additionally, it may be necessary to limit the number of claims approved each year or over certain time periods, to ensure that future claimants are treated equitably.
Predicting the exact size or timing of these percentage decreases or caps on claims is impossible because the total volume and timing of claims filed within any given year remain completely unpredictable. Claimants who have already filed should anticipate that final payouts may be lower than current rates. The payment percentage can be reduced at any time and without prior notice. Claimants should plan for this by reading the instructions carefully, providing necessary documentation as quickly as possible and paying particular attention to emails requesting additional information. Reimbursements are determined by the authorized payment percentage in effect at the exact time the claim is finalized and approved for payment, not when the claim was originally submitted.
A database of claimants who are affected by a decrease in the payment percentage will be maintained so that additional payments might be made if funds are available. If necessary, a supplemental claim process will be set up.
